I bet John Cage wouldn't sue. After all, any sound can be part of that composition, as long as it is part of your ambient environment. Probably lots of copyright material has been part of this classic over the years.
It was really an interesting experience, having a marching band director who was a John Cage fan. Admittedly he saved the Cage for our stage concerts, not football games... but that represents his state of mind. We were called upon to perform a lot of music and maneuvers that might have been considered too advanced for high schoolers, and usually rose to the challenge!
